Each commission is created as a lasting keepsake, a way to make time stand still and keep feelings and memories preserved.

Please note: By commissioning a painting, you agree to be bound by the terms and conditions outlined below.

These terms apply to original artwork commissioned directly from Safiyyah Choycha (“The Artist”) by an individual collector (“The Client”).
Commission Process
Enquiry
The Client may contact The Artist through the commission enquiry form on The Artist's website to discuss a potential commission.
The Client may provide reference photographs and details of any flowers, landscapes, colours, atmosphere or other elements they would like The Artist to consider.
Reference material is used as inspiration and a starting point rather than something that will be reproduced exactly.
Consultation
The Artist will follow up by email to discuss the proposed painting, including style, size, medium, framing where applicable, and any particular elements discussed with The Client.
The final painting will be created through The Artist's own interpretation and established artistic style. By commissioning an original painting, The Client acknowledges that variations and artistic interpretation are an inherent part of commissioning an original work of art.
Before payment is made, the principal details of the commission and the final price will be confirmed with The Client.
Pricing & Payment
Pricing
The price of a commission will depend upon its size, medium, framing where applicable, and the requirements of the proposed painting.
A final quotation will be provided following the initial consultation.
Payment
Full payment is required upfront to secure the commission and reserve a place within The Artist's commission schedule.
If the commission is cancelled before The Artist has begun work, the commission payment will be refunded, subject to any applicable statutory rights and agreed costs already expressly authorised by The Client.
Once The Artist begins creating the commissioned artwork, 50% of the total commission price becomes non-refundable. This reflects the time reserved within The Artist's schedule, creative work undertaken and materials committed to the commission.
If The Client chooses to cancel after work has begun, The Client will receive a refund of the remaining 50% of the commission price.
In the rare event that The Artist is unable to complete the commission after work has begun, The Client will receive a refund of the remaining 50% of the commission price.
If The Artist is unable to proceed with the commission before work has begun, the commission payment will be refunded in full.
Nothing within these terms is intended to limit any statutory rights that The Client may have under applicable consumer law.
Timeline & Delays
The timeframe for completion will vary upon the size and complexity of the commission. This will be discussed and confirmed before the commission begins.
*Please note there is a minimum 6 week lead time on all commissions.
Delays: Should there be any delays in completing the commission due to, but not limited to, unforeseen circumstances, material shortages, or random acts of God, The Artist will notify The Client as soon as possible.
Artistic Interpretation, Revisions & Approval
The Artist will send photos of the completed painting to The Client for final approval before delivery. Any requests for changes after this stage may incur extra fees.
Commissioned artwork is created in The Artist's established artistic style and according to The Artist's artistic judgement.
Once the painting has been completed, The Artist will provide photographs to The Client before delivery.
Reasonable minor adjustments may be discussed at this stage where The Artist considers them appropriate and technically possible.
Requests that substantially change the agreed composition, subject or direction of the painting may incur an additional charge and may not be possible once the work has been completed.
Because original artwork is viewed differently under different lighting conditions, and because screens and photographs reproduce colour differently, the physical painting may vary slightly in colour and tone from digital photographs.
Reasonable minor adjustments may be discussed at this stage where The Artist considers them appropriate and technically possible.
Requests that substantially change the agreed composition, subject or direction of the painting may incur an additional charge and may not be possible once the work has been completed.
Because original artwork is viewed differently under different lighting conditions, and because screens and photographs reproduce colour differently, the physical painting may vary slightly in colour and tone from digital photographs.
Shipping & Delivery
Shipping: The Artist offers domestic and international shipping options via UPS, FedEx and DHL All shipping costs are the responsibility of The Client unless otherwise agreed upon.
Packaging: While The Artist takes every care to ensure paintings are carefully packaged to prevent damage during transit, The Artist does not accept responsibility for any damage or misuse that may occur once the package has been handed over to the carrier.
Cancellations & Refunds
If The Client cancels the commission before The Artist has begun work, the payment will be refunded subject to the provisions above and any applicable statutory rights.
Once work on the painting has begun, 50% of the total commission price is non-refundable and The Client will receive a refund of the remaining 50% if they choose to cancel.
Due to the bespoke nature of commissioned artwork, refunds will not ordinarily be offered simply because The Client changes their mind after the completed artwork has been approved, subject always to The Client's statutory rights.
Nothing within these terms affects rights relating to artwork that is faulty, damaged or otherwise not supplied in accordance with applicable law.
Copyright & Use of Artwork
Copyright
Copyright and all intellectual property rights in the commissioned artwork remain with The Artist unless expressly transferred through a separate written agreement.
Purchasing the original physical painting does not transfer copyright or reproduction rights.
Client Use
The Client may display, enjoy, gift or subsequently sell the physical original artwork.
The Client may not commercially reproduce the artwork, create or sell reproductions or products featuring the artwork, license the image to another party, or otherwise commercially exploit the image of the artwork without prior written permission from The Artist.
Artist Use
The Artist retains the right to photograph and reproduce images of the commissioned artwork for The Artist's portfolio, website, social media, exhibitions, publications and promotional purposes unless otherwise agreed in writing before the commission begins.
Ownership of the physical painting does not prevent The Artist from retaining and exercising copyright in the image.
Privacy & Data Protection
Personal information provided by The Client will be used as reasonably necessary to communicate about, administer and fulfil the commission.
Relevant information may be shared with service providers where necessary to fulfil the order, including delivery providers and other businesses involved in preparing or delivering the artwork.
Personal information will otherwise be handled in accordance with The Artist's applicable privacy policy and legal obligations.
Agreement
Before the commission proceeds, The Client will be provided with these Terms & Conditions and the agreed details of the commission.
By confirming the commission and making the required payment, The Client agrees to the Terms & Conditions applicable to the commission, subject to applicable consumer law.
The terms applicable to a commission are those agreed at the time the commission is confirmed. Any subsequent changes to The Artist's standard Terms & Conditions will not retrospectively alter an existing commission unless agreed by both parties in writing. any updates that may affect their ongoing commissions.
